ApyHub Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the products, services, APIs, applications, software, and website provided by ApyHub B.V. (“ApyHub”, “we”, “us”, or “our”), including but not limited to the ApyHub API marketplace, API catalog, and related services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
1. Eligibility and Acceptance
You may use the Service only if:
- You are legally capable of entering into a binding contract;
- You are not prohibited from using the Service under applicable laws;
- You comply with these Terms and all applicable laws and regulations.
If you use the Service on behalf of a company or legal entity, you represent and warrant that you have authority to bind that entity to these Terms.
2. Changes to These Terms
We may modify these Terms from time to time. If we make material changes, we will provide notice by email, through the Service, or by posting an updated version on our website at least seven (7) days before the changes become effective.
Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the updated Terms.
3. Privacy
Our collection and use of personal data are governed by our Privacy Policy.
In the event of any conflict between these Terms and the Privacy Policy, the Privacy Policy will prevail with respect to personal data matters.
4. Description of the Service
ApyHub provides a platform through which APIs, software utilities, and related services may be published, discovered, managed, tested, and consumed.
The Service includes:
- The ApyHub API Catalog;
- Hosted APIs and utility services;
- Developer tools, dashboards, analytics, and related infrastructure.
Some APIs may be developed directly by ApyHub, while others may be provided by approved third-party API providers.
Subject to these Terms, ApyHub grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service.
5. Account Registration
To access certain features of the Service, you must create an account.
You agree to:
- Provide accurate and complete registration information;
- Keep your account credentials secure;
- Promptly update your account information;
- Accept responsibility for all activities occurring under your account.
You must notify us immediately of any unauthorized use of your account.
Disposable Email Addresses
ApyHub does not permit accounts registered using disposable or temporary email addresses. We reserve the right to suspend or disable accounts that violate this policy.

6. Subscription Plans and Billing
Subscription Plans
ApyHub offers multiple subscription plans for its products and services. Plan features, pricing, API limits, storage limits, and usage allowances may vary.
We reserve the right to:
- Modify pricing;
- Adjust plan features or limitations;
- Add or remove APIs or functionality;
- Introduce new subscription tiers.
Any material pricing changes affecting active subscriptions will become effective at the next renewal period unless otherwise stated.
Billing
Subscriptions are billed in advance on a recurring monthly or annual basis, depending on the selected plan.
By subscribing, you authorize ApyHub and its payment processors to charge your selected payment method.
Upgrades and Downgrades
- Upgrades take effect immediately and may be prorated;
- Downgrades take effect at the end of the current billing cycle.
Cancellation and Refunds
You may cancel your subscription at any time through your account payment settings.
Unless required by applicable law, all subscription payments are non-refundable, including in cases where the Service, API calls, or included credits are not used, partially used, or not used at all during a billing period.
It is your responsibility to downgrade or adjust your subscription plan prior to the next billing cycle if you expect lower usage. Failure to use the Service or its included resources does not entitle you to a refund or credit.
Upon cancellation, your subscription remains active until the end of the paid billing period.
API Credits (Atoms)
ApyHub may offer prepaid usage credits (“Atoms”) that can be purchased by users in addition to or separately from subscription plans. Atoms may be used to perform additional API calls or consume Service resources once included plan limits are exceeded.
Purchased Atoms do not currently expire and remain available for use in the user account indefinitely. However, ApyHub reserves the right to introduce a reasonable expiration policy for Atoms in the future, provided that users are given advance notice as required under these Terms.
Atoms have no cash value, are non-transferable except as expressly permitted by ApyHub, and are not refundable except where required by applicable law.
7. API Providers
Third-party API providers may publish APIs on the ApyHub platform subject to approval by ApyHub.
API providers are solely responsible for:
- Their APIs;
- API documentation and content;
- Compliance with applicable laws;
- Accuracy of descriptions and pricing;
- Their relationships with API consumers.
ApyHub reserves the right to suspend or remove APIs at its discretion.
API providers grant ApyHub the right to host, display, market, distribute, and provide access to their APIs through the Service.
Service Certification and Transparency Program
ApyHub operates a Service Certification Program designed to improve transparency, security, and compliance across APIs available on the platform.
Where applicable, APIs listed on the Service may be accompanied by certification disclosures provided by the API provider. These disclosures are intended to help consumers understand how each API handles data and compliance-related matters.
Certified APIs may include standardized information such as:
- Data storage and processing locations (including geographic regions);
- Data retention policies for inputs, outputs, logs, metadata, and aggregated data;
- Use of third-party infrastructure or subprocessors involved in data processing;
- Links to relevant privacy policies and data protection documentation;
- Applicable security and compliance frameworks or attestations (which may include GDPR, ISO/IEC 27001, SOC 2, OWASP API Security guidelines, OAuth 2.0 / OpenID Connect, or similar standards);
- Certification validity periods and last updated timestamps where applicable.
API providers are solely responsible for ensuring that all certification-related information submitted to ApyHub is accurate, complete, and kept up to date. ApyHub does not independently verify all provider claims unless explicitly stated.
API providers further agree that they must not provide false, misleading, or materially outdated information in relation to any certification, compliance status, or data handling practice. Providers must promptly update ApyHub in the event of any material changes affecting previously published certification information.
ApyHub reserves the right to:
- Request supporting documentation for any certification or compliance claim;
- Update, suspend, or revoke certification labels or indicators at its sole discretion;
- Remove APIs from the Service if certification or transparency requirements are not met.
The Service Certification Program is provided for informational purposes only and does not constitute legal, regulatory, or compliance advice, nor does it guarantee full compliance with any specific legal framework by ApyHub or any third-party API provider.
8. Acceptable Use Restrictions
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the Service;
- Circumvent usage limits or security protections;
- Interfere with the integrity or availability of the Service;
- Upload malicious code, malware, or harmful content;
- Use the Service for unlawful or fraudulent purposes;
- Resell or sublicense the Service without authorization;
- Conduct penetration testing or load testing without prior written approval;
- Use the Service in safety-critical environments where failure could cause injury, death, or environmental harm;
- Violate the intellectual property rights of ApyHub or others;
- Use the Service to send spam, abusive communications, or deceptive content.
We may suspend or terminate accounts that violate these restrictions.
9. Intellectual Property
All rights, title, and interest in the Service, including software, trademarks, branding, documentation, APIs, website content, and related materials, remain the exclusive property of ApyHub or its licensors.
Except as expressly permitted under these Terms, you may not reproduce, distribute, modify, or create derivative works from the Service.
User Content
You retain ownership of any content or data you submit to the Service (“User Content”).
You grant ApyHub a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display User Content solely as necessary to operate and improve the Service.
Feedback
If you provide feedback or suggestions regarding the Service, you grant ApyHub the unrestricted right to use such feedback without compensation or obligation.
10. Copyright Complaints
If you believe content on the Service infringes your intellectual property rights, please contact us at hello@apyhub.com with sufficient details regarding the alleged infringement.
We reserve the right to remove allegedly infringing content and suspend repeat infringers.
11. Availability and Support
ApyHub will use commercially reasonable efforts to maintain Service availability.
However, we do not guarantee uninterrupted or error-free operation of the Service.
Scheduled maintenance, third-party infrastructure failures, force majeure events, or technical issues may result in temporary interruptions.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APYHUB DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.
APYHUB DOES NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE;
- THE SERVICE WILL MEET YOUR REQUIREMENTS;
- DATA WILL ALWAYS BE ACCURATE OR SECURE;
- DEFECTS WILL BE CORRECTED.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APYHUB SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL;
- SERVICE INTERRUPTIONS OR SECURITY BREACHES CAUSED BY THIRD PARTIES.
APYHUB’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNTS PAID BY YOU TO APYHUB DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
14. Indemnification
You agree to defend, indemnify, and hold harmless ApyHub and its affiliates, officers, employees, contractors, and partners from any claims, liabilities, damages, losses, and expenses arising from:
- Your use or misuse of the Service;
- Your violation of these Terms;
- Your violation of applicable laws or third-party rights;
- Any content or data submitted through your account.
15. Suspension and Termination
You may stop using the Service at any time.
ApyHub may suspend or terminate your access to the Service immediately if:
- You violate these Terms;
- Your use creates legal or security risks;
- Required by law;
- Necessary to protect the Service or other users.
Upon termination:
- Your access rights immediately cease;
- Outstanding payment obligations remain due;
- Sections intended to survive termination will continue in effect.
16. Data Protection and GDPR
Where applicable, ApyHub processes personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection laws.
Where required, separate Data Processing Agreements (DPAs) may apply.
17. Third-Party Services
The Service may depend on or integrate with third-party infrastructure, platforms, or software providers.
ApyHub is not responsible for the availability, functionality, or security of third-party services.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Netherlands, excluding conflict of law principles.
Before initiating formal proceedings, both parties agree to attempt to resolve disputes in good faith.
If a dispute cannot be resolved within sixty (60) days, the dispute shall be submitted to arbitration in Amsterdam, Netherlands, under the rules of the Dutch Arbitration Association.
The arbitration shall:
- Be conducted in English;
- Be handled by a single arbitrator;
- Be final and binding.
Nothing in this section prevents either party from seeking injunctive or equitable relief for intellectual property violations.
19. Force Majeure
ApyHub is not liable for delays or failures resulting from causes beyond its reasonable control, including natural disasters, cyberattacks, infrastructure outages, labor disputes, acts of government, or failures of third-party providers.
20. Miscellaneous
Independent Contractors
The parties are independent contractors. These Terms do not create any partnership, agency, or employment relationship.
Assignment
You may not assign, transfer, delegate, or otherwise dispose of these Terms or any rights or obligations under these Terms without ApyHub’s prior written consent. Any attempted assignment in violation of this section will be null and void.
ApyHub may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of assets.
These Terms shall be binding upon and inure to the benefit of the parties and their permitted successors and assigns.
Third-Party Infrastructure
The Service may rely on third-party hosting providers, cloud infrastructure, payment processors, communication providers, analytics tools, and other third-party services (“Third-Party Infrastructure”).
ApyHub does not control and is not responsible for outages, interruptions, security incidents, delays, or failures caused by Third-Party Infrastructure providers. To the maximum extent permitted by law, ApyHub disclaims all liability arising from or related to third-party infrastructure or services used in connection with the Service.
Electronic Communications
By using the Service, you consent to receiving electronic communications from ApyHub, including notices, invoices, disclosures, security alerts, and updates relating to the Service.
You agree that such electronic communications satisfy any legal requirement that communications be in writing.
You may withdraw your consent to receive non-essential electronic communications by contacting hello@apyhub.com, though certain service-related communications may remain necessary for account administration and security purposes.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law, and the remaining provisions will remain in full force and effect.
If necessary, the invalid or unenforceable provision shall be deemed modified so that it is enforceable while preserving its original intent as closely as possible.
Force Majeure
ApyHub shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to natural disasters, acts of government, war, terrorism, labor disputes, cyberattacks, telecommunications failures, cloud infrastructure outages, utility interruptions, internet disruptions, pandemics, or failures of third-party service providers.
